Terms and Conditions
It is agreed that the following terms set out the total agreement between the parties and that no variation or modification shall be effective unless agreed by both parties in writing.
Booking Fee
A non-refundable booking fee of £200 is charged when the client signs this contract. This fee is deductible in full from the total price.
Payments
Following payments of the booking fee, half of the remaining balance is due to be paid 15 days before the date of the wedding as detailed in the schedule. The remaining balance is due on delivery of the proof images.
Display
The client hereby allows Adrian Beese Photography to display any images included in this contract in his portfolio, literature, web site wedding exhibitions and advertising.
Images
All image sizes are nominal. Adrian Beese Photography will endeavour to provide a pleasing colour balance but cannot guarantee exact colour matching owing to the anomalous reflectance cause by a combination of certain dyes and materials, especially man made fibres. It is sometimes impossible to reproduce exact colours seen by the human eye.
Retouching
Retouching of the images over and above what would considered to be normal by the photographer is a chargeable extra.
Reorders
All reorders shall treated as an extension of this contract and no responsibility will be excepted unless orders are given in writing.
Copyright
Any images or copies of images whether stored digitally or otherwise are protected by the Copyright, Designs and Patents Act 1988. It is contrary to this act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of Adrian Beese in writing.
Digital Files
Digital files remain the property of Adrian Beese. They will be stored indefinitely on the understanding that whilst every care will be taken of them, their long term integrity cannot be guaranteed.
Licence
Adrian Beese Photography shall be granted artistic licence in relation to the poses photographed and locations used. Adrian Beese Photography’s judgment regarding the poses, location and number of images shall be deemed correct.
Due to the vagaries of weather and the willingness of subjects it may not be possible to capture all the images requested. Adrian Beese Photography’s Judgment regarding relevance or non-relevance of subject matter shall be deemed correct unless specifically informed. Adrian Beese Photography will endeavour to capture as much of what is relevant to the event as possible. However, Adrian Beese Photography cannot guarantee everything will be recorded.
Force majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
